If that was me I would have shot him the moment I saw the gun and would have kept shooting till he fell down and stopped moving and that's without the ordering him to do so.
It's better to be judged by 12 then carried by 6.
I would shot him when i saw him take the gun out.. Told him "Drop it or face the consequences" and if he didn't, pop a cap in his head O.O
